These Terms of Use ("Terms") govern your access to and use of the Dicey Poker mobile application and related services (the "Service"). "Dicey Poker", "we", "us" or "our" refers to the operator of the Service.
Please read these Terms carefully. By downloading, accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You may use the Service only if you are legally allowed to do so in your country. If you are under the age required to form a binding agreement, you may use the Service only with permission from your parent or legal guardian.
Dicey Poker is not intended for children under 13. If you are under 13, do not use the Service.
2. Your Account
Some features require an account. You agree to provide accurate information, keep your login credentials secure and not allow others to use your account. You are responsible for activity that happens through your account.
You may delete your account from the profile screen in the app. Account deletion is described further in our Privacy Policy.
3. License to Use the Service
We grant you a limited, personal, non-exclusive, non-transferable and revocable license to use the Service for entertainment purposes, subject to these Terms, app store rules and applicable law.
We and our licensors retain all rights in the Service, including software, graphics, design, gameplay systems, text, images, logos, icons and other content, except for content you submit.
4. Rules of Conduct
You agree not to:
- harass, threaten, abuse, impersonate or harm other players;
- post unlawful, hateful, obscene, defamatory, violent or otherwise inappropriate content in chat;
- cheat, exploit bugs, manipulate scores, ratings, leaderboards or subscriptions;
- use bots, scripts, automation or reverse engineering to interfere with the Service;
- attempt to access accounts, data, servers or systems without authorization;
- upload malware, spam or content that infringes another person's rights;
- use the Service for commercial, illegal or unauthorized purposes.
We may remove content, restrict access, delete games, reset scores, suspend accounts or take other action when we believe these Terms, the rules of the Service or applicable law have been violated.
5. Chat, Reports and User Content
The Service may allow you to send chat messages, submit reports, block users and send rule suggestions or feedback. You remain responsible for the content you submit.
Do not share private, confidential or sensitive information in chat. Other players may see your nickname, country flag, game activity, leaderboard entries and chat messages.
By submitting messages, rule suggestions, feedback or other content, you grant us a worldwide, royalty-free license to host, store, display, moderate, modify and use that content as needed to operate, improve, protect and promote the Service. For rule suggestions and feedback, you agree that we may use them without compensation or obligation to you.
6. Games, Scores, Ratings and Leaderboards
Dicey Poker is an entertainment game. Scores, ratings, leaderboards and game results have no cash value and do not represent real-world money or property.
We may correct, remove or reset scores, ratings, games, leaderboard entries or other records if we believe they are incorrect, fraudulent, abusive, caused by a bug or inconsistent with the integrity of the Service.
7. Premium, Purchases and Subscriptions
The Service may offer premium features, subscriptions or other paid content. Purchases are handled by Apple App Store or Google Play, depending on your device. Their payment terms, refund rules and subscription management tools apply.
If you buy a subscription, it may renew automatically unless cancelled before the renewal date through your Apple App Store or Google Play account settings. We do not receive or store full payment card details.
Except where required by applicable law or app store rules, payments are non-refundable. For payment, refund, cancellation or billing issues, please use the applicable app store support tools.
8. Advertising
The Service may show advertisements to non-premium users. Ads may be provided by third-party advertising partners. Advertising choices and privacy settings are described in our Privacy Policy.
9. Third-Party Services
The Service depends on third-party services such as Apple App Store, Google Play, Firebase, AdMob and device notification services. We are not responsible for third-party terms, privacy practices, outages, decisions, content or payment processing.
10. Updates, Changes and Availability
We may update, modify, suspend or discontinue all or part of the Service at any time. We may also change game rules, features, premium benefits, limits, content, leaderboards or technical requirements.
We may update these Terms from time to time. When we do, we will update the "Last updated" date. Your continued use of the Service after changes become effective means you accept the updated Terms.
11. No Warranty
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of availability, accuracy, fitness for a particular purpose and non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, secure, compatible with every device, or free from bugs or data loss.
12. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, profits, goodwill, game progress, ratings, leaderboard position, subscription access caused by app store issues, or other intangible losses arising from your use of the Service.
13. Indemnity
You agree to defend and indemnify us from claims, damages, liabilities, losses and expenses arising from your use of the Service, your content, your violation of these Terms or your violation of applicable law or third-party rights.
14. Termination
You may stop using the Service at any time and may delete your account in the app. We may suspend or terminate access to the Service if we believe you violated these Terms, created risk for other users, abused the Service, or if we are required to do so by law or platform rules.
15. Governing Law
These Terms are governed by applicable law without regard to conflict-of-law rules. Nothing in these Terms limits consumer rights that cannot be waived under the laws of your country of residence.
